Will: John Mart (1798-1876)

John Mart is my 3rd great grandfather.

The transcription reads:

This is the last Will and Testament of me John Mart of Alsop en le Dale in the County of Derby. Being of sound mind, memory and understanding do make publish and declare this my last Will and Testament in manner and form following, that is to say. First I direct that my body may be disposed of in that manner that may be most agreeable to my Executors hereinafter mentioned and that all my just debts, funeral expenses and the charges of proving this my Will be fully paid & satisfied by my said Executors out of my personal estate. I give devise or bequest to my son John William Mart, to my daughter Mary Ann Hannah, to my son Jesse Josiah, to my son George Thomas, to my daughter Sarah Ann Ellen and to my daughter Angelina share and share alike of my property whether personal or real estate to be divided and paid to them when the youngest child arrives at the age of 21 years all monies property & remaining after all due expenses are paid to be placed in good security by my Executors the Interest to be given at times to my eldest daughter if needed in case of sickness or necessity for my younger children. If my eldest son John William should die before the time expired for dividing and leave no issue then his share to be divided equally among the rest. If either of the rest should die before receiving their dividend their share shall be equally divided, I give to my daughter Mary Ann Hannah for her sole use all my household furniture, linen and effects whatsoever kind or nature in my possession at the time of my decease as a recompense over and above the rest of my family that she provide a home for my younger children in time of need or sickness until my youngest child attains the age of 21 years. And I do hereby nominate constitute and appoint John Hurd, Robert Goldsworthy Executors of this my last Will. And I do hereby revoke all former Wills, Codicils, testamentary dispositions and appointments whatsoever by me at any time heretofore made in Witness whereof. I have hereunder set my hand this 24 day of August in the year of our Lord One Thousand eight hundred and seventy five.
